The Conditions apply to all art sales made through the Association between the Artist and the Buyer. They are intended to govern the relationships between the Artist and the Buyers of the work of art, excluding those established between the Buyers and MAG Arts or between the Artist and MAG Arts.
The relations between the Buyers, the Artist and MAG Arts are governed by the Conditions of Acquisition. MAG Arts is not the seller of artwork purchased through the Association; only the Artist, whose name is indicated on the description of each artwork, is the contractual party towards the Buyer for the purchase of these artworks.
The Buyer has the option of having the artwork delivered to his home by indicating this when ordering. The artwork will be delivered to the address indicated by the Buyer when ordering. In this case, the Artist, provided that he has confirmed the availability of the artwork and that MAG Arts has notified him of receipt of payment, is responsible for packaging the artwork and making it available to a carrier.
MAG Arts will also assume responsibility for packaging and shipping by agreement with the artist.  Transport costs will be accepted by the Buyer upon validation of their acquisition.
Depending on the Buyer’s shipping address, different tax rules and additional fees may apply. If the Buyer ships items from a Partner Gallery located outside of its territory, the Buyer may be required to pay import duties upon receipt of the artwork. Neither we nor the Partner Galleries have any control over these charges and we cannot predict their amount. The Buyer will be responsible for paying these import duties and taxes which are not included.
The Buyer is free to contact their local customs office for more information before placing their order. The Artist undertakes to make the ordered Work available to the carrier within the timeframes indicated. The artwork are delivered to the address indicated by the Buyer when ordering and must be delivered no later than 10 working days after confirmation of the availability of the Work to the carrier by the Artist or MAG Arts, the timeframe varying depending on the carrier chosen. It is the Buyer’s responsibility to ensure that the information he/she provides to MAG Arts for this purpose is and will remain accurate and that it will allow him/her to receive the artwork/s he/she has purchased. The Artist undertakes to communicate to MAG Arts, who will then transmit to the Buyer, the name of the carrier handling the transport of the artwork to the Buyer as well as the package number. This allows the Buyer to track the status of his/her shipment on the carrier’s website.
The Buyer may also come and collect the artwork (s) purchased directly from the MAG Arts space. The Artist, subject only to MAG Arts having confirmed receipt of full payment, will deliver the artwork, the invoice and the certificate of authenticity to the Buyer.
